Introduction and Acceptance of Terms

Welcome to QRShift, a dynamic QR code service designed to help businesses and individuals create, manage, and track QR codes for printed materials. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Service Description

QRShift provides users with a platform to:

  • Create Dynamic QR Codes: Generate QR codes that redirect to URLs which can be changed at any time without reprinting
  • Multiple Content Types: Create QR codes for websites, contact cards (vCards), WiFi networks, files, images, videos, social media profiles, app downloads, email, phone, and payment links
  • Customize QR Styles: Personalize QR code appearance with custom colors, patterns, logos, and styles
  • Track Scans: Monitor QR code performance with analytics including scan counts, geographic location, device types, and more
  • Manage QR Codes: Edit, pause, or delete QR codes at any time

User Accounts and Registration

Account Creation

To access certain features of the service, you need to create an account. You must:

  • Provide accurate and complete information during registration
  • Be at least 16 years of age
  • Use a valid email address that you have access to

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

Account Restrictions

You may only create one account per person. Creating multiple accounts to abuse free tier limits or promotional offers is prohibited and may result in account termination.

Subscription Plans and Billing

Subscription Tiers

QRShift offers various subscription plans with different features and limits:

  • Free Plan: Limited QR codes with basic features
  • Pro Plan: More QR codes, advanced analytics, custom short links, and additional export formats
  • Business Plan: Unlimited QR codes, full analytics, API access, custom domains, and priority support

Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis
  • All prices are displayed in USD unless otherwise specified
  • You agree to pay all applicable fees associated with your selected plan

Refund Policy

  • All subscription purchases are final and non-refundable
  • You may cancel your subscription at any time, and your access will continue until the end of the current billing period
  • No partial refunds are provided for unused portions of a subscription period

Plan Changes

  • You may upgrade your plan at any time; upgrades take effect immediately
  • Downgrades take effect at the start of the next billing period
  • We reserve the right to change pricing with 30 days notice to existing subscribers

Acceptable Use Policy

Permitted Use

You may use QRShift for legitimate business and personal purposes, including but not limited to:

  • Marketing campaigns and promotional materials
  • Product packaging and labeling
  • Business cards and contact sharing
  • Event management and ticketing
  • Menu displays and restaurant services
  • Educational materials

Prohibited Activities

You agree NOT to use QRShift to:

  • Malicious Content: Direct users to malware, viruses, phishing sites, or any harmful content
  • Illegal Activities: Promote or engage in illegal activities, including fraud, identity theft, or copyright infringement
  • Deceptive Practices: Create QR codes that mislead users about their destination or purpose
  • Spam: Generate QR codes for unsolicited bulk messaging or spam campaigns
  • Adult Content: Host or link to explicit adult content without proper age verification
  • Harassment: Harass, threaten, or harm others
  • System Abuse: Attempt to overload, hack, or disrupt our systems or circumvent usage limits
  • Reselling: Resell or redistribute the service without authorization

Content Responsibility

You are solely responsible for the content your QR codes link to. QRShift does not monitor the content of destination URLs but reserves the right to suspend or terminate QR codes that violate these terms.

Intellectual Property Rights

QRShift Platform

All technology, software, designs, and content comprising the QRShift service are the intellectual property of QRShift and are protected by copyright and other intellectual property laws.

Your Content

  • You retain ownership of the content you link to through QRShift
  • You grant QRShift a license to process and store your QR code data to provide the service
  • You represent that you have all necessary rights to the content you link to

Trademarks

QRShift, the QRShift logo, and related marks are trademarks of QRShift. You may not use our trademarks without prior written permission.

Privacy and Data Collection

QR Code Scanner Data

When someone scans a QR code created through QRShift, we collect:

  • IP address and approximate geographic location
  • Device type, browser, and operating system
  • Timestamp of the scan
  • Referrer information

This data is used to provide analytics to QR code owners and improve our service.

Your Data

Please refer to our separate Privacy Policy for complete details on how we collect, use, and protect your personal information.

API Usage

If your plan includes API access:

  • API keys are personal and should not be shared
  • Rate limits apply based on your subscription plan
  • Excessive API usage that impacts service performance may be throttled
  • API access may be revoked for abuse or violation of these terms

Service Availability and Modifications

Uptime

We strive to maintain high service availability but do not guarantee 100% uptime. Planned maintenance will be communicated in advance when possible.

Service Changes

We reserve the right to:

  • Modify, suspend, or discontinue any part of the service
  • Add or remove features
  • Update these terms

Material changes will be communicated via email or through the service.

Termination

By You

You may terminate your account at any time by:

By QRShift

We reserve the right to terminate or suspend your account without notice if you:

  • Engage in fraudulent or illegal activities
  • Fail to pay subscription fees

Effect of Termination

Upon termination:

  • Your access to the service will cease
  • Your QR codes will stop redirecting (or redirect to a default page)
  • Your data may be deleted after a reasonable retention period
  • You remain liable for any outstanding fees

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QRSHIFT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • UNINTERRUPTED OR ERROR-FREE SERVICE
  • ACCURACY OR RELIABILITY OF ANY INFORMATION
  • SECURITY OF YOUR DATA

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QRSHIFT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Any damages exceeding the amount paid by you in the 12 months preceding the claim

Indemnification

You agree to indemnify and hold harmless QRShift, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content linked to through your QR codes

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the service will be resolved through binding arbitration, except for claims that qualify for small claims court.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QRShift regarding the service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign your rights under these Terms. QRShift may assign its rights to any successor or acquirer.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms. We will provide 30 days notice for material changes.
